To ensure the security of confidential data transmission, our website uses the most well-known and established protocol for secure web transactions: Secure Socket Layer (SSL). SSL technology ensures that confidential data travels over the internet only in encrypted form, ensuring it is unreadable by third parties. Using an SSL Secure Server is very simple and requires no special procedures. Sending and receiving data via an SSL Secure Server is typically indicated by the browser with a warning window and a page address with the https prefix (the classic http is supplemented with an "s" at the end) and a "Closed Padlock" icon displayed at the bottom left or right. If you choose to pay by credit card via PayPal, the personal data page will take you to a PayPal page where you can enter your card details and then send them to the bank via the SSL Secure Server. The Bank will then credit the amount to the seller's account.
No information about your card ever comes into the possession of www.orsolamainardis.it.
Object of the online contract and its definition
By online sales contract we mean a distance contract, i.e. a legal transaction concerning movable goods and/or services stipulated between a supplier, Orsola Mainardis Jewels by Orsola M. with VAT number 03247370277 and CF MNRRSL70T44G224P and a consumer customer within a distance selling system organized by the supplier who, for this contract, uses exclusively the remote communication technology known as the internet, at the website corresponding to the address www.orsolamainardis.it. A consumer customer is defined as a natural person who purchases goods and/or services from the seller's website for purposes not directly related to any professional activity they may carry out. By placing an order through the various methods provided, the customer declares that they have read all the information provided during the purchase process and fully accepts the general conditions of sale set forth below. The contract will be concluded upon acceptance of the Order Confirmation by the customer, indicated by clicking the "Confirm Order" button at the end of the purchase process.
By accepting the "Order Confirmation," the customer also confirms unreserved acceptance of the Terms of Sale set forth here. These Terms of Sale will remain in effect until modified by the supplier; any changes to the Terms of Sale will be effective upon publication on the website www.orsolamainardis.it and apply to sales made from that point onward.
Guarantee of conformity
The guarantee of conformity of the products sold by the Seller to the Consumer Customer is provided pursuant to the provisions of Legislative Decree no. 206 of 6 September 2005 (Consumer Code) on guarantees in the sale of consumer goods. The Seller provides the official guarantee for a period of 24 months from the date of purchase. The Consumer forfeits the right to assert the aforementioned guarantee if he or she fails to report the lack of conformity within 2 months of its discovery. The guarantee is valid for the following defects:
• the product does not correspond to the agreement;
• the product does not correspond to the usual use and quality;
The Seller will not be liable for any damage resulting from misuse or wear, improper handling or installation, or malfunction due to a short circuit. The warranty does not apply to factors other than normal use of the product, such as voltage increases or decreases, use of inappropriate or prohibited accessories, falls, water, fire, or incorrect or abusive use by the Customer or third parties not authorized by the manufacturer. The warranty also does not apply to defects that were already known to the Customer at the time of purchase.
Methods: Before returning a non-compliant item, and in order to enforce the warranty, it is the Customer's responsibility to agree, including via email, on the return and delivery methods for the product with the Seller. The Seller undertakes to inform the Customer of the location and shipping method for the product. Once the Product has been received, the Seller will inspect it, including using the Manufacturer's facilities, and, if a defect is found, will send the Customer the repaired or replacement product.
If, upon inspection, the product is found not to be defective, the Seller will inform the Customer of the costs of repair or replacement. The Customer will be charged for shipping costs for products that do not exhibit defects. In the event of a defect being reported, the Seller will promptly contact the Customer to inform them and, if necessary, propose replacing the defective product with alternative products of equivalent or higher value and quality.
Conventional warranties, whether free or paid, offered by the manufacturer or retailer do not replace or limit the legal guarantee of conformity, which may differ in scope and/or duration. Anyone offering conventional warranties must always specify that these are different and additional guarantees to the legal guarantee of conformity that protects consumers.
Right of withdrawal and refund
Pursuant to Article 64 of Legislative Decree 206/2005, the buyer has the right to withdraw from the sales contract without penalty and without specifying the reason within 14 working days of receiving the goods, as provided for by Legislative Decree 206/2005.
The right of withdrawal is exercised by sending, within the above-mentioned deadline, a registered letter with acknowledgement of receipt to the following address:
Dorsoduro 394 30123 (Venice) ITALY
The notice of withdrawal may also be sent, within the same deadline, by telegram, telex, email, and fax, provided that it is confirmed by registered letter with acknowledgement of receipt within the following forty-eight hours.
Registered mail is considered sent in due time if delivered to the accepting post office within the same timeframe. However, acknowledgement of receipt is not an essential requirement for proving the exercise of the right of withdrawal.
Within the same 14-day period from receipt of the goods, the buyer is required to return the purchased goods.
For the purposes of the deadline, the goods are considered returned when they are delivered to the accepting post office or to the forwarding agent.
The substantial integrity of the product to be returned is an essential condition for exercising the right of withdrawal.
The only costs owed by the buyer for exercising the right of withdrawal are the direct costs of returning the goods (shipping costs).
If the right of withdrawal is exercised in accordance with these contractual conditions, Orsola Mainardis Jewels di Orsola M. will refund the purchaser the sums paid as quickly as possible and, in any case, pursuant to Article 67 of Legislative Decree 206/2005, within 14 days of the date the goods are returned. The sums are considered refunded within the terms provided they are actually returned, shipped, or re-credited with a value date no later than the expiration of the indicated 14-day period.
In the event of forfeiture of the right of withdrawal, Orsola Mainardis Jewels di Orsola M. will return the purchased item to the sender, charging the latter the shipping costs again.
